These Terms of Use ("Terms") govern your access to and use of the website at forecight.com and its subdomains (the "Site"), operated by Forecight Cybersecurity Inc. ("Forecight," "we," "us," or "our"). By accessing or using the Site, you agree to these Terms. If you do not agree, please do not use the Site.
1. Informational purpose only
The content on this Site is provided for general information about Forecight and its services. It does not constitute professional, security, legal, or other advice, and should not be relied upon as such. Cybersecurity guidance is only meaningful in the context of a specific engagement and environment; nothing on the Site is a substitute for advice tailored to your circumstances. We may change, update, or remove content at any time without notice.
2. No client relationship
Using the Site, contacting us through it, or submitting a form does not create a consulting, advisory, or other professional relationship between you and Forecight. A relationship arises only under a separate written agreement signed by both parties.
We treat what you send us through the Site as confidential, and use it only to respond to you — see our Privacy Policy. Receiving it does not, however, create any professional or fiduciary duty on our part, and does not by itself prevent us from acting for others.
3. Intellectual property
All content on the Site — including text, graphics, logos, icons, images, page layouts, and the compilation of that content — is owned by Forecight or its licensors and is protected by copyright, trademark, and other intellectual-property laws. "Forecight," the Forecight logo, and related marks are trademarks of Forecight Cybersecurity Inc. Third-party names, logos, and marks appearing on the Site are the property of their respective owners and are used for identification only; their appearance does not imply endorsement.
4. Permitted use
You may view and use the Site for lawful, personal, and internal business purposes. You may not: copy, reproduce, republish, or redistribute Site content except as reasonably necessary for those purposes; frame or mirror the Site; use automated means to scrape or harvest content or data; attempt to gain unauthorized access to any system or network connected to the Site; introduce malware or interfere with the Site's operation or security; or use the Site in any way that breaches applicable law or these Terms.
5. Forms and event registration
Where the Site offers contact forms, incident-response intake, or event registration, you agree to provide accurate and complete information and to submit only information you are authorized to share. Send only what we need in order to respond: please do not include credentials, keys, log excerpts, or copies of affected data. Where responding to an incident calls for that material, we will open a secure channel for it rather than take it through this Site. We may decline, limit, or revoke access to any form, registration, or event at our discretion. Event registrations may be subject to additional terms communicated at the time.
6. External links
The Site may link to third-party websites and resources for convenience. We do not control and are not responsible for the content, accuracy, availability, or privacy practices of those sites, and links do not imply endorsement. Accessing third-party sites is at your own risk and subject to their terms.
7. Disclaimer of warranties
The Site and its content are provided on an "as is" and "as available" basis without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or availability. We do not warrant that the Site will be uninterrupted, secure, or error-free, or that content is current or complete.
8. Limitation of liability
To the fullest extent permitted by law, Forecight and its affiliates, and their directors, officers, employees, and agents, will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, revenue, or profits, arising from or related to your use of or inability to use the Site, even if advised of the possibility. Nothing in these Terms excludes liability that cannot be excluded under applicable law.
9. Changes to these Terms
We may update these Terms from time to time. The "Revised" date above indicates when they were last changed, and your continued use of the Site after any change constitutes acceptance of the revised Terms.
10. Governing law
These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable there, without regard to conflict-of-laws principles. The courts located in British Columbia will have exclusive jurisdiction over any dispute arising from these Terms or the Site.
11. Severability
If any provision of these Terms is held to be invalid or unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will continue in full force and effect. The invalidity of one provision does not affect the validity of the rest.
12. Entire agreement
These Terms, together with our Privacy Policy and Cookie Policy, are the entire agreement between you and Forecight regarding your use of the Site, and supersede any prior understanding on that subject. They do not vary or replace the terms of any separate written agreement between us, which govern the services provided under them.
13. No waiver
If we do not enforce a provision of these Terms, that is not a waiver of our right to enforce it later. A waiver is effective only if we give it in writing, and a waiver on one occasion does not waive any other provision or the same provision on another occasion.
